Delhi HC granted bail to film director Sanoj Kumar Mishra in rape case, ‘Still another case of false complaint’

The Delhi High Court has granted bail to film director Sanoj Kumar Mishra, who was accused of raping a woman, stating that the case showed the recent trend of lodging false complaints of sexual offenses.

The High Court said that in her affidavit, the woman testified that she was living in a relationship with Mr. Mishra and had agreed to establish physical relations with her, and had filed a complaint under the influence of some of her rivals.

Justice Girish Kathpalia was informed by the SHO of Nabi Karim that he has already started the process for registration of an FIR against the complainant woman and all the persons who had allegedly conspired to make a lodge false complaint against the accused.

“This is still another case, reflecting the recent trend of lodging false complaints of sexual offenses. Every false complaint of sexual offenses not only causes great harm to the person accused of crime, but also causes blasphemous and mistrust in the society, which also harasses victims of sexual offenses,” The court said in his order on 30 May.

Senior advocate Amit Chadha, who was present for Mr. Mishra, presented that his customer has been forced to stop him in the film industry by the complainant.

The lawyer said that the accused and prosecution were in a long living relationship, that too in Mumbai, and according to the prosecution, the alleged crime ork in the ork, Madhya Pradesh, so Delhi had no jurisdiction.

The High Court also mentioned that in the affidavit, the complainant has also testified that he has no objection if the accused is released on bail.

Keeping in mind the circumstances, Justice Kathpal said that he did not find any reason to deprive any other accused of freedom.

The High Court granted him bail for presenting a personal bond of and 10,000 and granting such an amount of amount.

Earlier, the High Court had denied anticipatory bail by the High Court, after which he was arrested on 30 March in connection with the crime under alleged offenses under alleged offenses under Section 376 (Rape), 354C (Vioorism), 313 (causes of abortion), 323 (hurt) and 506 (criminal interimity).
